EU AI Act Article 88 is the internal-facing counterpart to Art.87's external complaint mechanism. Art.88 sits adjacent to Art.87 but addresses a different enforcement vector. An individual affected by a high-risk AI credit decision uses Art.85 and Art.87. An employee who discovers that their company's AI system is operating as a prohibited practice under Art.5 — and who fears losing their job for speaking up — uses Art.88. The two pathways can operate in parallel: an affected person can file an Art.87 complaint and that complaint can be supplemented by an Art.88-protected internal disclosure from someone with access to the system's technical documentation.
Art.88(1): Internal Reporting Channel Obligation
Art.88(1) requires providers, deployers, notified bodies, and other entities covered by the Regulation to comply with the reporting channel obligations of Directive 2019/1937. The directive's obligations apply based on organisation size:
Organisations with 50 or more employees must establish, maintain, and operate a dedicated internal reporting channel that meets all of the following requirements:
- Secure and confidential: reports can be submitted in writing (online or postal), orally (telephone), or in person upon request; the identity of the reporter must be protected
- Acknowledged within seven days: the channel operator must confirm receipt of the report within seven days of receiving it
- Follow-up within three months: the channel operator must provide feedback on the action taken within three months of the acknowledgement

- Anonymous reporting facilitated: where national law requires, anonymous reports must be accepted and processed with the same protections as identified reports
Organisations with fewer than 50 employees are not automatically required to maintain their own internal channel. They may use:
- Shared channels established by competent authorities for small entities in the same sector
- Shared channels established by municipal or regional government bodies
- Voluntary internal channels established by the organisation itself
Notified Bodies and Market Surveillance Authorities themselves are subject to Art.88 obligations — they must maintain internal channels for their own staff to report violations of the Regulation that they encounter in their assessment and oversight functions.
The practical implication: an AI provider with 50 or more employees developing a high-risk AI system (Annex III) must have a functioning Art.88-compliant internal reporting channel before deploying that system. The channel is not just for AI Act violations — it covers all violations that Directive 2019/1937 applies to — but the AI Act explicitly requires that AI Act breaches fall within its scope.
What the Internal Channel Must Accept

Art.88(2): Protected Persons
Art.88(2) defines who is protected when they make a report. The protection extends to all persons who, in a work-related context, have acquired information about a violation and report it in good faith. The scope is deliberately broad:
Primary protected persons:
- Employees: both permanent and fixed-term, full-time and part-time
- Self-employed persons and contractors: freelancers, consultants, and independent service providers engaged to work on or with the AI system
- Shareholders and members of governing bodies: including non-executive directors who become aware of violations through board-level information
- Persons subject to probationary periods and interns: protection applies from day one of the work relationship
- Volunteers and trainees: unpaid participants in development or deployment activities
- Former employees: who acquired the information during their employment — the protection does not end at termination
Extended protection (third parties):
- Job applicants: who became aware of a violation during a recruitment process (e.g., were shown system architecture or asked to evaluate a non-compliant system)
- Facilitators: persons who assist the reporter in making the report — colleagues who help draft the disclosure, union representatives, legal advisors
- Associated third parties: persons connected to the reporter who might suffer retaliation — family members, colleagues, other employees in the same team
"Work-related context" defined: The protection applies when the person acquired the information in the course of their work — they are not required to have been involved in the violation itself. A data analyst who discovers a prohibited practice while working on an unrelated project is protected. A subcontractor's employee who identifies a training data violation during integration work is protected.
Good faith requirement: The reporter must genuinely believe, on reasonable grounds, that the information they are disclosing is accurate. A report made in good faith that turns out to be incorrect does not strip the person of protection. A report made with knowledge that it is false — to harm a competitor or a colleague — is not protected and may itself be actionable.
Art.88(3): Prohibited Retaliation
Art.88(3) prohibits any form of retaliation against persons who make protected disclosures. Directive 2019/1937 provides the specific list of prohibited retaliatory measures, which Art.88 incorporates by reference:

The retaliation prohibition applies from the moment the report is made — not only after an investigation is completed or a violation is confirmed. A company that dismisses an employee within days of receiving their internal report, citing performance reasons, faces the burden-shifting rule described below.

Art.88(4): Burden of Proof Reversal
Art.88(4) establishes the most operationally significant protection in Art.88: where a person who has made a protected disclosure subsequently suffers an adverse measure, the burden of proof shifts to the employer to demonstrate that the adverse measure was not taken in retaliation for the disclosure.
The reversal mechanism:
Without Art.88: In ordinary employment disputes, the employee must prove that the employer's adverse action was retaliatory. This is difficult — adverse actions are rarely labelled as retaliation and employers can often construct facially neutral justifications.
